IS COURT MARRIAGE THE ONLY WAY TO LEGALIZE MY MARRIAGE?

In India weddings are not a small affair, people take months to prepare for the wedding of their children, however, in between all these preparations, getting your marriage registered is the most important step essential to get your marriage legalized. Steps important to register marriage in India-

The marriage certificate in India is a legal document affirming the marriage of two people in India. Marriages in India are register under Hindu Marriage Act, 1955 or the Special marriage Act, 1954. The Supreme Court of India in 2006 made it mandatory to register a marriage so as to legalize it.

Online registration for Marriage Certificate-

· Open the government’s official website of your home state.

· Open the form for marriage registration on the site

· Personal details of both parties are to be filled in the form

· Submit the form.

· After the form is submitted, the marriage registrar would call the parties to be present at a particular time and date. It is compulsory to be present at the office with the necessary documents which are mentioned below.

Required Documents-

The documents required may vary from state to state. The standard documents for every state have been mentioned below-

· Application form signed by the couple.

· Document for date of birth of both parties.

· Residential proof of both parties, i.e. could be election voter ID, PAN card, Aadhar Card, Ration Card or Electricity Bill.

· If the marriage took place at a religious place, a certificate from the institute is required.

· A payment of Rs100 if the marriage was solemnized under the Hindu Marriage Act, 1955, if the marriage was solemnized under the Special Marriage Act, 1954. The receipt of the payment is to be attached with the application form.

· Two passport sized photos of the parties, also the marriage photo if the marriage has been solemnized.

· Invitation card of the marriage if the marriage has already been solemnized.

· Also, the parties have to give affirmation that they do not fall within the degrees of the prohibited relationship as provided under the Act.

· If the party is previously divorced or widowed, then a copy of the decree of divorce or the death certificate of the previous spouse is also required to be attached.

· An affidavit shall be attached with the application form which states the place of marriage, date of marriage, the time of marriage, marital status of the parties and the nationality of both the parties.

· If the marriage has been solemnized, then two witnesses who were present at the wedding are also required to be present in the office of the sub-registrar at the time of the meeting.

As per the Hindu Marriage Act, 1955

· The parties applying for the registration under this Act, can apply only if they are Hindus, Sikhs, Jains or Buddhists.

· If the marriage is solemnized, the couple can apply for registration

As the Special Marriage Act, 1954

· Every citizen of the country can apply for marriage under the Special Marriage Act, irrespective of their religion, caste, place of birth etc.

· They have to get their marriage solemnized in the presence of the marriage officer. Commonly the marriages performed are called court marriage.

· A proper procedure for the Court Marriage In Mumbai has been provided under the Act.

· After the Court Marriage In Gurgaon is completed, the marriage automatically gets registered and there is no need to have it registered separately.
